1.1.3Vision, Mission and Key objectives Vision
To maximize exports and foreign exchange earnings through Special Economic Zones (SEZs) and Export Oriented Units (EOUs) in the State of Gujarat.
Mission
Promote the twin Export Promotion Schemes of SEZ and EOUs in Gujarat and guide entrepreneurs in setting up industrial & service units, nurture their growth, facilitate export and import operations and develop export Infrastructure, in close co-ordination with concerned Departments of Government of India and Government of Gujarat.
Objectives
The main objectives of SEZ and EOU schemes are :
  • generation of additional economic activity:
  • promotion of exports of goods and services:
  • promotion of investment from domestic and foreign sources;
  • creation of employment opportunities; and
  • development of Infrastructure facilities
1.1.4Functions1. Under the SEZ Jurisdiction
  1. To approve industrial & services units in the SEZ under the provisions of SEZ Act, 2005.
  2. To review and monitor performance of the SEZ units in terms of Letter of Approval conditions.
  3. To discharge functions of 'Developer' as ‘KASEZ Authority' constituted under SEZ Act, 2005 for development, operation and management of Kandla SEZ.
2. As Zonal Development Commissioner
  1. To monitor development of SEZ in the State of Gujarat and review their performance.
  2. To co-ordinate with the Departments, Agencies, Organizations of Central and State Governments to ensure hassle free working of SEZs and to resolve procedural and policy issues arising out of functioning of the SEZ Developers and Units.
3. Under the EOUS jurisdiction
  1. To promote setting up of EOUs in Gujarat.
  2. To co-ordinate with the Customs and Central Excise Departments for Import-Export facilitation
  3. To review and monitor performance of the EOUs in terms of Letter of Permission conditions.

Answer: The salient features of the SEZ scheme are:-

A designated duty free enclave to be treated as a territory outside the customs territoryof India for the purpose of authorised operations in the SEZ;
No licence required for import; Manufacturing or service activities allowed;The Units are only requiredto achieve Positive Net Foreign Exchange to
becalculated cumulatively for a period of five years from the commencement of production;Domestic sales subject to full customs duty and import policy
in force;Full freedom for subcontracting;No routine examination by customsauthorities of export/import cargo;SEZ Developers /Co-Developers and Units enjoy
Direct Tax and Indirect Tax benefits as prescribed in theSEZs Act, 2005.

Question : What are the major incentives and facilities available to SEZ developers?

Answer : The major incentives and facilities available to SEZ developers are as under:

Exemption from customs/excise duties for development of SEZs for authorized operations approved by the BOA.Income Tax exemption on income derived from the
business of development of the SEZ in a block of 10 years in 15 years under Section 80-IAB of the Income Tax Act. (Sunset Clause for Developers has become
effective from 01.04.2017)Exemption from Central Sales Tax (CST).Exemption from Service Tax (Section 7, 26 and Second Schedule of the SEZ Act).Supplies to
SEZ are zero rated under IGST Act, 2017.

Question: What are the incentives and facilities offered to the units in SEZs for attracting investments into the SEZs, including foreign investment ?

Answer: The incentives and facilities offered to the units in SEZs for attracting investments into the SEZs, including foreign investment include:

Duty free import/domestic procurement of goods for development, operation and maintenance of SEZ units100% Income Tax exemption on export income for SEZ units
under Section 10AA of the Income Tax Act for first 5 years, 50% for next 5 years thereafter and 50% of the ploughed back export profit for next 5 years.
(Sunset Clause for Units will become effective from 01.04.2020)Exemption from Central Sales Tax, Exemption from Service Tax and Exemption from State sales tax.
These have now subsumed into GST and supplies to SEZs are zero rated under IGST Act, 2017. Other levies as imposed by the respective State Governments. Single
